This policy explains what we collect, why, who sees it, and how long we keep it. Section 4 covers mobile information and text messaging consent, which we treat more strictly than anything else on this list.
This Privacy Policy explains what Berkley Consulting collects when you use getberkley.com, submit a form, use the chat widget, call us, text us, or work with us, how we use it, who we share it with, and what control you have over it. Please read it so you understand our practices. If you do not agree with this policy, do not use the site. By accessing or using the site you agree and consent to this policy.
Berkley Consulting is a trade name of Berkley Financial Group LLC, 244 Madison Avenue, Suite 326, New York, NY 10016. Berkley Financial Group LLC is the party responsible for the information described here (the data controller for information collected through this site). Our messaging, chat, form, and CRM tools are provided by LeadConnector / GoHighLevel, which processes that information on our behalf as a service provider / data processor.
This Privacy Policy is subject to and governed by our Terms and Conditions.
We may collect two types of information when you visit the site: Personal Information and Non-Personal Information.
Personal Information is data by which you may be personally identified, such as name, email address, employer, job title, and telephone number.
Non-Personal Information is data about you that does not identify you specifically. If you do nothing during your visit but browse, read pages, or view content, we may gather and store information about your visit that does not identify you personally.
If you reach us through a referral or a third-party platform, we may receive your contact details from that source. We do not buy contact lists, and we do not accept purchased lists for text messaging. We may also obtain information through partners, vendors, public databases, or social platforms where those parties are legally permitted to disclose it. We take steps to confirm that information we receive from third parties has been collected with your consent or that those parties are otherwise legally permitted to disclose it to us. In some cases we combine Personal Information about individuals that we receive from multiple sources, including information collected directly from you or through your use of the site.
Some site or messaging features may use tools that leverage artificial intelligence to help route or draft replies. We do not retain your Personal Information to develop, improve, or train generalized artificial intelligence or machine learning models.
Legal basis (EEA and United Kingdom visitors). If you are in the European Economic Area or the United Kingdom, we collect Personal Information only where we have your consent, where we need it to perform a contract with you, where we have a legal obligation, or where processing is in our legitimate interests (such as administration, direct marketing of our own services, product improvement, preventing fraud, and information security) and those interests are not overridden by your data protection rights. Berkley Financial Group LLC is the data controller of Personal Information collected through this site, except where a service provider processes it on our instructions as a processor.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who provide support services, such as our customer messaging platform, is permitted solely so that those services can be delivered to you.
All other categories of data sharing described in this policy exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties, excluding aggregators and providers of the text message services.
We do not share your phone number or opt-in consent with third parties unless we have received your express written consent to do so. Mobile information, mobile numbers, and SMS consent records are never sold, rented, or shared with third parties, affiliates, or lead generators for marketing, promotional, or lead generation purposes. The only parties who ever handle your mobile number are the vendors named in section 5 who deliver the messaging service to you under contract, and they may not use it for their own purposes. Consent given to Berkley Consulting applies only to Berkley Consulting and is never transferred to another business.
We collect your mobile number only when you give it to us, and we send text messages only where you have given prior express consent through one of the opt-in methods described in section 6 of our Terms and Conditions. The SMS consent checkbox on our forms is unchecked by default, is separate from any other agreement, and is never required in order to submit a form or to become a client.
You can withdraw consent at any time by replying STOP to any message, by emailing support@getberkley.com, or by calling +1 646-347-2825. After you opt out we keep a record of the opt-out itself, so that we can honor it.
We share personal information only in these situations, and always subject to the limits in section 4:
We may share non-personally identifiable information, such as anonymized or aggregated information, with suppliers for analysis, trend identification, and research.
We use cookies, pixel tags, and similar technologies to keep the site working, to remember basic preferences, and to understand which pages people find useful. Analytics data is aggregated and is used to improve the site, not to build a profile of you as an individual. Technologies similar to cookies, such as pixel tags, may also be used in connection with the site and with messages we send.
You can block or delete cookies in your browser settings. If you do, parts of the site may not work as intended. We honor Global Privacy Control signals where your browser sends one.
Some browsers incorporate a “Do Not Track” (DNT) feature that, when turned on, signals to websites that you do not want to be tracked. At this time the site does not respond to DNT signals, other than Global Privacy Control where that signal is present.
We will only retain your Personal Information for as long as reasonably necessary to fulfill the purposes we collected it for, including satisfying legal, regulatory, tax, accounting, or reporting requirements and the other purposes described in this policy. We may retain it longer if there is a complaint or a reasonable prospect of litigation in respect of our relationship with you. To determine the appropriate period we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, whether we can achieve the purpose by other means, and applicable legal requirements. In some circumstances we will anonymize Personal Information so that it can no longer be associated with you, in which case we may use that information indefinitely without further notice to you.

We keep information longer only where the law requires it, or where it is needed to establish or defend a legal claim.
You can ask us to:
Email support@getberkley.com with your request and the email address or phone number you used with us. We respond within 30 days, or sooner where the law requires it. We may ask you to provide information to verify your identity. We will not treat you differently for exercising a privacy right. If you request deletion, we may still need to retain certain information for recordkeeping, to complete a transaction you began, or to comply with applicable law.
You can designate an authorized agent to make a request on your behalf in certain circumstances. If you use an authorized agent, we may ask you to verify your identity or confirm that you provided the agent signed permission to submit the request.
Depending on where you live you may have additional rights under state or international privacy law, including the right to know, the right to delete, the right to correct, and the right to opt out of sale or sharing. As stated in section 6, we do not sell personal information and we do not share it for cross-context behavioral advertising.
If you are in Europe, you may have additional rights under the GDPR, the UK GDPR, or Swiss data protection law. You can request access to, a copy of, correction of, or deletion of your Personal Information, object to processing, ask us to restrict processing, or request portability, by using the contact details in the “How to reach us” section. If we have collected your Personal Information with your consent, you can withdraw that consent at any time. If you believe we are using your Personal Information in a way that is inconsistent with this policy, you may contact your local data protection authority.
This section is addressed to California residents and describes rights under the California Consumer Privacy Act (CCPA), as amended. Subject to certain exceptions, California residents have the right to be notified about the collection, use, disclosure, sale, or sharing of their Personal Information; to request access to, deletion of, or correction of their Personal Information; to opt out of the “sale” or “sharing” of Personal Information; to limit the use or disclosure of Sensitive Personal Information; and not to be discriminated against for exercising those rights.
Berkley Consulting does not sell your Personal Information. We do not share it for cross-contextual targeted advertising. If we collect Sensitive Personal Information, we limit our use to uses you have authorized, uses required to fulfill your requests, or uses otherwise allowed by the CCPA or required by other laws.

Retention for each category follows section 8. Business purposes include functionality, customer support, business operations, communication, advertising of our own services, and statistical purposes.
If you are a resident of Colorado, Connecticut, Utah, or Virginia, you may have rights under the Colorado Privacy Act, the Connecticut Data Privacy Act, the Utah Consumer Privacy Act, or Virginia’s Consumer Data Protection Act. Those laws generally grant the right to be notified about collection and use of Personal Information; to request access, deletion, or correction; and, in some states, to opt out of targeted advertising, sale, or certain profiling, and not to be discriminated against for exercising those rights.
You can exercise those rights using the details in the “How to reach us” section. If we decline to take action on your request, you may have the right to appeal by contacting us again and stating that you wish to appeal. If we have not responded or asked for additional time within 45 days after you send a request, Colorado residents may appeal that failure to take action by contacting us.
Berkley Financial Group LLC is based in the United States. We may transfer your Personal Information to the United States and to our service providers in other countries in order to operate the site and our messaging tools. Those countries may not have the same rights and protections as you do under local law. Whenever we transfer Personal Information beyond the country of origin, we will do so in accordance with applicable laws and this policy. We do not claim participation in the EU-U.S. Data Privacy Framework on our own account.
The site is designed to provide reasonable and appropriate administrative, technical, and organizational security measures to protect your Personal Information against risks such as temporary or permanent loss, destruction, and unauthorized or unlawful access, alteration, use, or disclosure. We require our suppliers and vendors to apply similar protections when they access or use Personal Information that we share with them. Users of the site must also do their part in protecting the data, systems, networks, and services they are using. No technology, data transmission, or system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please notify us immediately using the details below. Please do not send sensitive information to us by text message.
This site and our services are for businesses and are not directed to children. We do not knowingly collect, use, or disclose information from children under 18, or the equivalent minimum age depending on the jurisdiction (such as 13 in the United States under the Children’s Online Privacy Protection Act, or 16 in some other jurisdictions). If we learn that we have collected the Personal Information of a child under that age, we will take steps to delete it as soon as possible. If you are under 18, do not provide any information about yourself to us. If you become aware that information of a child has been provided, contact us using the details below.
We are not responsible for the practices employed by websites or services linked to or from this site, including the information or content contained therein. This policy does not address, and we are not responsible for, the policies and practices of third parties or other organizations that are not operating on our behalf. The inclusion of a link does not imply endorsement of the linked site or service. This includes any app developer, social media platform, operating system provider, wireless service provider, or device manufacturer. Read their policies before giving them information. Where you connect a social network or authorize a third-party service to interact with tools we use, that third party’s terms and privacy policy apply to the information you share with them.
We may update this policy at our discretion. The last-updated date at the top of this page shows when the current version took effect. Your continued use of the site after we make changes is deemed to be acceptance of and consent to those changes, so please check this page periodically. Where a change materially affects how we handle your mobile information, we will make that clear here before it takes effect.
